Battle Brews Over FBI’s Warrantless GPS Tracking - TIs Heads Up!

Kathy Thomas knew she was under surveillance. The animal rights and environmental activist had been trailed daily by cops over several months, and had even been stopped on occasion by police and FBI agents.

But when the surveillance seemed to halt suddenly in mid-2005 after she confronted one of the agents, she thought it was all over. Months went by without a peep from the FBI surveillance teams that had been tracking her in undercover vehicles and helicopters. That’s when it occurred to her to check her car.

Rumors had been swirling among activists that the FBI might be using GPS to track them — two activists in Colorado discovered mysterious devices attached to their car bumpers in 2003 — so Thomas (a pseudonym) went out to the vehicle in a frenzy and ran her hands beneath the rear bumper. She was only half-surprised to find a small electronic device and foot-long battery wand secured to her metal fender with industrial-strength magnets.

“I think I must have found it right after they put it on, because there was no grime on it at all,” she told Wired.com recently.

The use of GPS tracking devices is poised to become one of the most contentious privacy issues before the Supreme Court, should the high court agree to hear an appeal filed by the Obama administration last month. The administration is seeking to overturn a ruling by a lower court that law enforcement officials must obtain a warrant before using a tracker.

The constitutional matter until now has been left to district courts around the country to decide, resulting in a patchwork of conflicting rulings about the need for warrants. Meanwhile, a federal lawsuit filed in March by an Arab-American college student named Yasir Afifi alleges that the FBI violated his privacy rights when the agency placed a GPS device on his car without a warrant, and that the bureau targeted him simply because of his ethnic background.

In the midst of this legal controversy, Threat Level decided to take a look inside one of the devices — which are generally custom-made for law enforcement. Working with the teardown artists at iFixit, we examined the device Thomas found on her car nearly six years ago, which you can see in the photos and video accompanying this story.

When Thomas found the device on her vehicle back in 2005, she ripped it from the underside of her fender, but quickly grew fearful the FBI would raid her house if agents suspected she’d removed it. So she carried it in a duffel bag in her trunk for a week, while she and her boyfriend considered what to do.

When her lawyer called a local U.S. attorney to inquire about the device, the prosecutor acknowledged it belonged to the feds and said they wanted it back. But Thomas refused to hand it over, and the FBI seemed to drop the matter. Her attorney told Threat Level the government “basically abandoned it.”

She provided it to Wired.com recently, after reading a story about Afifi discovering a tracker on his car. She said she wanted to raise more awareness about how the technology is being used for stealth surveillance.

GPS vehicle trackers, based on technology first used by the military for navigation, have become a popular law-enforcement tool for tracking people. Cruder than other forms of surveillance — they report only where a suspect’s car goes, not who is in the car or what occupants do when they arrive at a location — they’re nonetheless frequently used for supplementary surveillance. That’s because in most jurisdictions, investigators don’t need court approval to slap a tracking device on a driver’s car, and because the devices provide a stealthier and more cost-effective approach to surveillance than a team of cops trailing a suspect around the clock.

The devices, however, have become one of the most divisive Fourth Amendment issues facing courts around the country. The 9th U.S. Circuit Court of Appeals in California ruled last year that using a GPS tracker was no different than physically trailing a suspect in public, and that such surveillance was not protected by the Fourth Amendment, even if agents placed the device on a suspect’s car while it was parked in his driveway.

But Judge Alex Kosinski, in the dissenting opinion, called the use of GPS trackers without a court order “straight out of George Orwell’s novel 1984” and said they give government “the power to track the movements of every one of us, every day of our lives.”

A federal appeals court in Washington, D.C., agreed with him when it ruled in a different case last year that collecting data from a GPS device planted on the Jeep of drug suspect Antoine Jones amounted to a search, and therefore required a warrant. Prosecutors argued that the device only collected the same information anyone on a public street could glean from following the suspect. But Judge Douglas Ginsburg wrote in his ruling that the persistent, nonstop surveillance afforded by a GPS tracker was much different from physically tracking a suspect on a single trip.

“Unlike one’s movements during a single journey, the whole of one’s movement over the course of a month is not actually exposed to the public because the likelihood anyone will observe all those movements is effectively nil,” he wrote. What’s more, the bulk of data gleaned by such a device over time could help deduce a lot about a person, such as whether he associated with political groups, was a heavy drinker or weekly churchgoer, was an unfaithful husband or an outpatient receiving regular medical treatment.

The Obama administration called the ruling “vague and unworkable,” and filed a writ in April asking the U.S. Supreme Court to review the case. A decision on whether the high court will hear the case is pending.

It’s not known how many people are tracked with GPS devices every year, but the devices don’t always go undetected. An elderly Arab-American in the San Francisco Bay Area reportedly discovered a vehicle tracker on his car in 2009, while he attended a free auto-repair workshop and let the instructor demonstrate an oil change on his vehicle.

Then last year, Yasir Afifi, a 20-year-old Arab-American college student in California discovered a device attached to his car when he took the vehicle into an auto shop for an oil change. After a friend posted photos of it on Reddit.com, and readers identified it as a GPS tracker, the FBI showed up at Afifi’s apartment demanding he return the device. He’s since filed a lawsuit (.pdf) over the tracking.

Although the Justice Department has said the devices are used by investigators “with great frequency,” neither the department nor local law enforcement agencies are required to compile or disclose statistics about their use in the way the Justice Department is required to report annually to Congress on the use of national security letters issued to ISPs and other businesses for customer records.

Kathy Thomas doesn’t know if the FBI obtained a warrant to place the tracker on her car. But she said authorities never charged her with any crime. Threat Level could find no federal case filed against her.

Her FBI file, which she obtained under a Freedom of Information Act request, makes it clear the surveillance was part of a nationwide investigation of activists connected to Earth First, the Earth Liberation Front and the Animal Liberation Front — groups the FBI considered “left-wing anarchists” whose members sometimes advocated criminal activity to further their aims.

Thomas, who provided Threat Level with only a handful of the 800 redacted pages she received in her request, says she organized activities with Earth First and participated in animal rights activities, but never belonged to the two other groups. Instead, she was a member of Food Not Bombs.

The FBI reports indicate agents likely turned to the GPS tracking device after it became increasingly difficult to tail her physically.

Thomas had begun engaging in countersurveillance maneuvers, FBI agents claimed in the documents, including speeding, running red lights, making unsafe lane changes and weaving through congested traffic to evade them. A July 2004 report describes how she drove one day into the cul-de-sac where she lived and sped around to confront and photograph cars she believed were tailing her. The report says Thomas was becoming “extremely surveillance-conscious,” and that agents “were made [recognized as agents] on two separate occasions.”

Thomas says the surveillance was a daily occurrence for months. Then in April 2005 she confronted an agent who was following her on the freeway. She took an exit ramp and stopped, and when he pulled up behind her, she got out of her car to yell at him, shaking a glass Perrier bottle in her hand. She says the agent laughed at her, and after that the surveillance stopped. Or so she thought.

She found the GPS tracker on her car a few months later.

The release by WikiLeaks of the secret assessments of hundreds of detainees by the Joint Interrogation Force at Guantanamo, spanning the period 2002 to 2009, provide little in the way of evidence of the tor­ture and abuse suffered by the supposed "enemy com­batants." While retelling the many pieces of gossip, infor­mant's tales and evidence of torture that are mixed in with any hard evidence of terrorist ties, the reports indicate in a number of instances "areas of potential exploitation" that go beyond that of mere intelligence gathering.

The listing of such "areas" appears to be limited to reports originating in 2006 and later.

Even when the aim of the "exploitation" areas are ostensibly re­lated to intelligence gathering, they often seek further informa­tion on al-Qaeda-related matters or individuals even after de­tainees have denied any connections to al-Qaeda or other extrem­ist groups, or have recanted such ties as were announced original­ly under tortured duress. It often appears the government is con­tinuing to hold prisoners, if not torture them, until the prisoner gives them the story they want to hear.

Indeed, that was the case with British resident Binyam Mohamed and supposed al-Qaeda "mastermind" Abu Zubaydah, both of whom were tortured by the CIA or allied forces in early 2002 to produce confessions of supposed plots that were later discredited, such as the "dirty bomb" plot purportedly cooked up by Mohamed and US citizen Jose Padilla.

As an example, the report on torture victim Mohamed al-Qahtani, called Maad al-Qahtani in his October 2008 report, still lists the "dirty bomb" and "attempts to acquire WMD" among its "areas of potential exploitation." Al-Qahtani was famously tor­tured in an early instance of the implementation of a new harsh interrogation regime approved by then-Secretary of State Donald Rumsfeld in the late summer of 2002. Logs recording his torture appeared in Time Magazine in June 2005.

While the "areas of potential exploitation" often included pre­sumed areas of further intelligence seeking, based upon supposed links of the detainee to the area under consideration, others areas of proposed "exploitation" are vaguer, or seem to imply research into prisoner psychology, or even possible status as an informant or intelligence asset after release.

For instance, the March 2008 JTF-GTMO Detainee Assessment for Mahmud al-Mujahid (Internment Serial Number [ISN] US9YM-000031DP) lists as an area of possible exploitation "De­tails of other bodyguards, fighters and al-Qaeda members, includ­ing those currently detained at JTF-GTMO." It also lists "Terror­ist biographical and psychological information."

The report on Sharqawi Abdu Ali al-Hajj (ISN PK9YM-0001457DP) is of extra interest, since, as Andy Worthington reported in April 2010, al-Hajj, along with detainee Sanad Yislam Ali al-Kazimi, were named by Judge Henry H. Ken­nedy Jr. in his decision granting the habeas corpus petition of Uthman Abdul Rahim Mohammed Uthman. According to Worthington, Kennedy noted, "The Court will not rely on the statements of Hajj or Kazimi because there is unrebutted evid­ence in the record that, at the time of the interrogations at which they made the statements, both men had recently been tor­tured."

Worthington also quoted a Human Rights Watch report in which al-Hajj, rendered to Jordan in 2002 and then later transferred to the CIA's "Dark Prison" near Kabul, before being sent to Guan­tanamo, described his torture:

"I was being interrogated all the time, in the evening and in the day. I was shown thousands of photos and I really mean thousands, I am not exaggerating ... And in between all this you have the torture, the abuse, the cursing, humiliation. They had threatened me with being sexually abused and electrocuted. I was told that if I wanted to leave with permanent disability both mental and physical, that that could be arranged. They said they had all the facilities of Jordan to achieve that. I was told that I had to talk, I had to tell them everything."

None of this is mentioned in al-Hajj's 2008 assessment. Instead, without further elaboration, he is mentioned as a possible subject of "exploitation" regarding "Terrorist biographical and psycholog­ical information," "Radicalization factors," "Other JTF-GTMO de­tainees" and "Detainee's intentions after released from US cus­tody."

Some of the detainees have listed as desirable the "exploitation" of knowledge of other detainees, which appears to be something close to acting as an informant, or at least snitching on other prisoners. In addition to the examples above, the report for Syrian prisoner Abd Al Rahim Abd Al Razzaq Janko (ISN US9SY-000489DP), states that besides further exploitation "of his own background information," another goal is "Other extrem­ists [sic] associates to include detainees in custody at JTF-GTMO."

Of further interest are the reports describing detainees known to be cooperating with US officials. According to a March 2010 ar­ticle by Peter Finn at The Washington Post, Tariq al-Sawah was one of "two of the most significant informants ever to be held at Guantanamo." Indeed his JTF-GTMO assessment records that he is "a highly prolific source" who "has provided invaluable intel­ligence." Al-Sawah and another detainee, Mohamedou Ould Slahi, are said in the Post article to "live a life of relative privilege - gar­dening, writing and painting - separated from other detainees in a cocoon designed to reward and protect. "

While approved for release, al-Sawah is still held at Guantanamo, while his assessment notes he is unlikely to "reestablish extrem­ist associations ... as his cooperation with the US government may serve to identify detainee as a target for revenge by those as­sociates."

Yet, Al-Sawah's assessment report, dated September 30, 2008, has a long list of possible "exploitation" possibilities, despite the supposed recommendation for his release, including "knowledge of extremist chemical and biological weapons, as well as their re­search and development by al-Qaida and other terrorist organiza­tions worldwide," "Terrorist biographical and psychological infor­mation" and "Radicalization factors of terrorism."

In addition, while al-Sawah has been held in US custody since early 2002, one possible source of "exploitation" mentioned in his 2008 assessment is "Possible ongoing terrorist operations in the U.S."

In a March 22 story at Truthout, Jason Leopold and Jeffrey Kaye revealed that the torture program used at Guantanamo and by the CIA was developed from a course at the military's Survival, Evasion, Resistance, Escape (SERE) school meant to protect US personnel against "exploitation" by foreign captors, including tor­ture in captivity to produce false confessions, propaganda activity and recruitment of informers. This course, known as SV-91, or "Psychological Aspects of Detention," provided the material for re­verse engineering an offensive "exploitation" torture program for the United States.

According to the Truthout article, "Jessen wrote that cooperation is the 'end goal' of the detainer, who wants the detainee 'to see that [the detainer] has "total" control of you because you are com­pletely dependent on him and thus you must comply with his wis­hes. Therefore, it is absolutely inevitable that you must co­operate with him in some way (propaganda, special favors, con­fession, etc.).'"

Air Force psychologist Bruce Jessen and Air Force survival school personnel Michael Kearns and Roger Aldrich developed the origin­al course. Jessen went on to become a CIA contract interrogator after 9/11 and is largely credited with transforming the use of the former SERE material into a torture program. Aldrich later be­came a "governing member" of Jessen's contracting company, Mitchell-Jessen and Associates. Captain (ret.) Kearns was never involved in interrogations and turned the Jessen materials over to Truthout.

In 2002, the US military instituted Behavioral Science Consulta­tion Groups at Guantanamo and later in Iraq and Afghanistan, which utilized psychologists and psychiatrists in the construction of detention policies as well as collaborating on interrogation plans with intelligence officials. Reports of behavioral and other kinds of experiments upon detainees have been discussed over the years, but no hard evidence of such experiments has come to light.

Nevertheless, Department of Defense (DoD) regulations concern­ing human subjects' protections were significantly changed in early 2002, allowing for suspension of human subjects protec­tions on DoD subjects, unless study subjects were prisoners of war. The US declared the Guantanamo prisoners as "unlawful enemy combatants," and denied them prisoner of war status al­most as soon as Guantanamo was opened.

It is difficult to conceive how "terrorist biographical and psyc­hological information" and "radicalization factors" come under traditional intelligence operations. Instead, they hint at study of individual detainees for psychological purposes, for possible uses in later interrogations, profiling, or constructing plausible though false narratives for prisoners, who then would be coerced into con­fession.

What accounts for radicalization was a matter of dispute in the re­cent military commissions trial of Omar Khadr, with a prosecu­tion forensic psychiatrist, Michael Welner, drawing upon the work of a controversial Danish psychologist, Nicolai Sennels, to paint a picture of the former child prisoner Khadr as someone who was too dangerous to release. The study of such "radicaliza­tion factors" has been a favorite topic of racist opponents to im­migration from countries that have Islamic populations.

No matter what kind of psychological information is being sought, the construction of psychological knowledge from supposed ter­rorist prisoners at Guantanamo, based upon what most news re­ports admit are large numbers of innocent individuals, will fail to construct a psychology of terrorism or "radicalization."

Instead, what we have is circumstantial evidence of ongoing illeg­al experimentation on prisoners, even in these sanitized and large­ly unreliable DoD reports on the Guantanamo detainees.

Mental entrainment, inducing hypnogogic trance, mind control, broadcasting thoughts and feelings, the Ant World, education via EM [LW] mental download, the "Feelies," revolution in spirituality, "enlightenment machine?" Scalar churches?

Psychoenergetics is simply using the scalar interferometers to manipulate and engineer the human psyche. To me it is the most mind-boggling and frightening aspect of longitudinal wave engineering.

The mind is electromagnetic in nature, and itself of the time-domain. It is not observable in 3-space. There is nothing you can point to that is the mind. As Bearden says, "The mind is time-like."

The longitudinal scalar EM waves are also of the time-domain. By overlaying certain infolded patterns (oscillations in time) on the longitudinal waves, a thought or feeling may be made to arise in a person or persons who are in the interference zone (where the wave beams cross).

The person will not notice anything, feeling that this thought or idea is his or her own idea. The longitudinal wave pattern might be a wave of panic or fear that spontaneously sweeps over you, perhaps inexplicably. It could even be in the form of a sudden intense patriotism. It could be explicit words and phrases, which everyone would think they had thought of by themselves. Or it could be rage and hatred, angry and violent. On the other hand It could also be a continuous sense of docility and placidity. This is the brave new world of psychoenergetics and the coming "Mind Wars."

Scalar Psychoenergetics in its most primitive form simply "entrains" all minds in the target area into a deep hypnogogic trance. In this state of mind people would be suddenly extremely suggestible, and would likely believe anything they are told, and would obey any orders given. Talk about winning the hearts and minds of the American People!

Tom Bearden makes me think of Paul Revere, who heroically conveyed important warnings for the sake of the new nation. But the words of the famous phrase have now strangely and curiously mutated into the once-inconceivable: "One if by land, Two if by mind."

Indeed one strategy in a Mind War would be to simply take over the minds of the "leaders" of the enemy nation. The targeted leader would not be aware that anything was amiss, although he might begin to make unexpected changes in policy.

And are, in fact, any of our "leaders" already having secret thoughts that are not their own? Who knows? Frighteningly, we can no longer be sure.

The new sciences of scalar electromagnetics and psychoenergetics are even now plunging humanity into a sudden science-fiction-like world beyond anything in humanity’s previous imaginings.

Bearden illustrates how a Scalar War would involve a psychoenergetics attack on the operators of the enemy scalar installation, entraining their minds into hypnogogic trance and getting them to shut down their systems. And ultimately psychoenergetic warfare goes to the very heart of human identity itself.

For if my thoughts might no longer be "mine,"

* Then who and what am I?
* Can my very sense of being "me" be hijacked by some nefarious psychoenergetic scheme?
* Will the "secret government" eventually dictate directly into your mind how you feel?
* Or what you think you are?
* Or what you should do?

How Does Longitudinal EM Mind Control Work?

The physics of scalar psychoenergetics as expounded by Col. Bearden seems even more arcane and over-my-head than that of extracting energy from the vacuum. I can’t understand it, but I look through it anyway. Each time another tiny understanding might occur, or a term might fall into place. I know the mathematics is forever beyond me.

One paper to begin with is Mind Control and EM Wave Polarization Transductions. This is such serious stuff that Bearden includes a strong warning about misuse of this knowledge.

Psychoenergetics weapons can mentally maim and physically kill.

After the serious warning comes the description of the paper. This is heady stuff for the layman.

"Calling full attention to the special note above, in this paper we present a high-level overview of the novel electromagnetic nature of mind operations, mind and body coupling, and intent - the induction of physical 3-space EM energy changes into the brain and nervous system, and into every cell of the body, from the mind’s time-like coherent operations.

We summarize the time-polarized electrodynamics used to engineer and affect mind operations and the mind-body coupling loop. Transaction mechanisms whereby differing EM wave polarization s can be transformed one-into-the-other are presented."

I will leave it to the technically astute to try to understand the mechanisms of operation which are described in scientific language. But there are tidbits for the layman.

Here he speaks of the difficulty Western scientists have in opening up to the "immaterial" (longitudinal wave) nature of the human mind.

Western Science Remains Largely Materialistic

"Ironically, most Western scientists are materialists and consider "mind" as a mystical and nonscientific concept. They tend to consider mind operations and functions either to be simply "meat computer" operations and functions, or at best to be very weak ordinary transverse-wave EM operations and functions in the brain and nervous system. This serious self-limitation exists because in the body we measure only weak TW [transverse wave] EM operations and functions correlated to biological behavior and brain operations. We simply do not know how to measure "mind operations" directly.

"With no mind measurements possible and no instruments, it is understandable that Western science considers only the physical side of the mind-matter interface.

"Presently our scientists do not measure the longitudinally-polarized EM wave operations and functions in the body and around it in nature. Few of them are aware that a maelstrom of such LW [longitudinal wave] functions exist in the body and in all of nature in general."

Western methods of influencing the mind with EM waves have only used transverse waves, not the longitudinal waves of the vacuum.

If only transverse waves are used one pretty well has to hit the target mind with a sledgehammer of waves.

Western Science knows only transverse EM waves

Brute Forcing Time Functions versus Fine Control Methods

"Ironically, Western mind control researchers using transverse EM waves for mind control research, are using a brute force method of evoking and using vacuum engines (spacetime curvature engines) and a special form of general relativity, although they do not appear to

"These "fitted brute-force models" certainly can be very powerful, and certainly can produce the exact results shown in the experimental verifications of the fittings. However, they do not of themselves allow sophisticated design for example of the necessary time-polarized wave assemblies for engineering the entire human collective unconscious simultaneously, or for engineering the entire collective unconscious of all species on Earth (i.e., Gaia's collective unconscious), or even for precisely engineering the memory and knowledge base of an individual.

The seemingly magical operations of psychoenergetics, sometimes called "psychotronics," cannot be achieved with ordinary transverse EM wave energy. But they are possible with longitudinal scalar waves because the mind itself is scalar in nature.

The engineering of the mind can only be accomplished with the waves of time.

The course of psychoenergetics development necessitates the building of a vast database of settings and patterns which bring about given mental and/or emotional states.

A kind of "gnome" of the psyche. Bearden describes the process of the decoding of this "gnome."

Summing up his paper Bearden speculates on what the actual situation the science of psychoenergetics probably is.

The intense secrecy with which this knowledge has been kept from the public has led to the current farce of the "government" pretending it all does not exist, and this secrecy may have now put us at great risk.

"The implication is that in the West one or more highly classified, sustained, heavily funded developments in advanced mind control programs, probably exists and probably has existed for some time. Due to loose formation of rogue groups inside such programs, they may have dual or triple purposes, may not operate under very much legitimate government control at all, and may operate specifically for the purposes of the rogue group or groups that have gained control.

"In a nutshell, that’s what may be going on in the clandestine mind control projects in several Western governments. The involvement of at least some rogue groups, some being "cowboys" who operate well outside all laws and ethics, could also result in such things as assassinations, clandestine testing on individuals without their consent, etc. In short, it could account for what seems to be actually occurring. As also is "usual" in such a mess, one or more of the rogue groups eventually may become very powerful because their secret weapons are very powerful. They may become confident, thinking they have the "best in the world." They may actually believe they are ahead of the Russians..."

"Remember that, in every large and powerful human organization, the basis for rogue groups is power and secrecy. They are always seeking to increase their power, control, influence, prestige, etc. Nothing else. Patriotism and mission are to rogue groups often just idle words. They have their own agendas. And being rogue groups, they may well bring in unethical, immoral tricks: assassination, bribery, entrapment, disinformation, plausible deniability, etc. A certain percentage of a highly secret rogue group will wind up using all these things and more. It’s a human characteristic, the old primate dominance game. Only now disguised and hidden under deep classification."

"The Russians, with their additional knowledge of the actual mechanisms in the transforms, will be much more advanced than the West, because their fundamental psychoenergetics science is far more advanced, so long as we continue to use the old U (l) electrodynamics. Further, the Russians have decades of use of longitudinal interferometry beams to reach right through the earth and ocean and produce stringent EM effects at a distance. So they will also be able to do the same things here in "mind control" with LW [longitudinal wave] interferometers, through intervening mass."

Bearden cites two examples where he believes the Russian KGB tested the psychoenergetics capabilities of their scalar interferometers.

One was the case of Captain Button in his A-10 "Warthog" aircraft on April 2, 1997.

Another was the case of Captain Amy Svoboda night training mission on May 27, 1997.

"Over Arizona, Captain Button was thrown into a hypnogogic state, and his perceptions instantly altered and controlled. In his instant "dream-waking" state, everything seemed perfectly normal. His sense of direction was altered a bit more than 90 degrees, so he simply corrected and turned and "flew toward the range", actually flying off course by more than 90 degrees and ignoring radio contacts. He flew right on out of Arizona."

"At one point he circled, probably thinking he was over the range, and he probably dropped his ordnance there. Then he "flew on back toward home," as he thought in his waking dream state, until his fuel ran out and he crashed and died in the explosion dream-thinking until he died that everything was normal. All the while, his sense of the passage of time was altered. To him, in his dream-thinking, dream-acting state, everything was normal and nothing untoward had happened. So the distant KGB transmitters and associated psychoenergetics team controlled him for over an hour.

In his book The Road to 9/11, now available in French, Professor Peter Dale Scott traces back the history of the "Deep State" in the United States, that is to say the secret structure that steers defense and foreign policy behind the facade of democracy. His analysis lifts the veil on the group that organised the September 11 attacks and which finances itself through international trafficking networks.

Regarded as a reference book, The Road to 9/11 already features as recommended reading at military-diplomatic academies. This interview is a follow-up to the article " Afghanistan: Opium, the CIA and the Karzai Administration", by Peter Dale Scott, Voltaire Network, 13 December 2010.

VoltaireNet: Professor Scott, as your work is not as widely known as it ought to be in French-speaking countries, could you please start by defining what “Deep politics” is, and explain the distinction between what you call the “Deep state” and the “Public state”?

Peter Dale Scott: The term “Deep state” comes from Turkey. They invented it after the wreck of a speeding Mercedes in 1996 in which the passengers were a Member of Parliament, a beauty queen, a local senior police captain, and an important drug trafficker in Turkey who was also the head of a criminal paramilitary organization – the Grey Wolves – that went around killing people. And it became very obvious in Turkey that there were a covert relationship between the police who officially were looking for this man – even though a policeman was there with him in the car – and these people who committed crimes on behalf of the state. The state that you commit crimes for is not a state that can show its hand to the people, it’s a hidden state, a covert structure. In Turkey, they called it the Deep state, [1] and I had been talking about deep politics for a long time so I used the term in The Road to 9/11. This is why I have defined deep politics as all those political practices and arrangements, deliberate or not, which are usually repressed rather than acknowledged. So the term “Deep state” – coming from Turkey – is not mine.

It refers to a parallel secret government, organized by the intelligence and security apparatus, financed by drugs, and engaging in illicit violence, to protect the status and interests of the military against threats from intellectuals, religious groups, and occasionally the constitutional government. In this book, I adapt the term somewhat to refer to the wider interface in America between the public, the constitutionally established state, and the deep forces behind it of wealth, power, and violence outside the government. You might call it the back door of the Public state, giving access to dark forces outside the law. The analogy with Turkey is not perfect, because what we see today in America is less a parallel structure than a wide zone or milieu of interaction between the public state and unseen dark forces, as I expound in my latest book The American War Machine. But this interaction is significant, and we need a name, such as Deep state, to describe it.

VoltaireNet: Your critically acclaimed book, The Road to 9/11, was published in 2007 under the Bush regime in the United States. In November 2010, you have published your latest body of work, The American War Machine, two years after Obama’s electoral victory; in your opinion, did the influence of the Deep state decrease in favor of the Public state after Mr. Obama’s election, or did it stay the same or even increase?

Peter Dale Scott: After almost two years of the Obama presidency, I have to conclude, regretfully, that the influence of the deep state, or more accurately what in my new book I call the American war machine, has continued to increase, just as it has under every US president since Kennedy. A key sign is the extent to which Obama, despite his campaign rhetoric, has continued to expand the scope of secrecy in US government, and especially to punish whistle-blowers: his campaign against Wikileaks and Julian Assange, who has not been charged yet with any crime, is without precedent in US history. I suspect that Washington’s fear of publicity is related to its awareness that US war policies are increasingly at odds with reality. In Afghanistan Obama appears to have capitulated to the efforts of General Petraeus and other generals to ensure that US troops do not begin to withdraw from combat in 2011, as originally foreseen when in 2009 Obama authorized a troop increase. Bob Woodward’s new book, Obama’s Wars, reports that during that protracted administration debate over whether to escalate in Afghanistan, CIA Director Leon Panetta advised Obama that “no Democratic president can go against military advice… So just do it. Do what they say.” Obama recently told US troops in Afghanistan that “you’re achieving your objectives, you will succeed in your mission.” This echo of earlier, fatuously optimistic statements from Petraeus explains why there were no realistic appraisal of the war’s progress inside the White House in December 2010, as was originally mandated.

Like Johnson before him, the president is now trapped in a quagmire war he dare not lose, and which threatens to spread to both Pakistan and Yemen, if not further. I suspect that the deep forces dominating both political parties are now so powerful, so affluent, and above all so invested in the profits from war-making, that a president is farther than ever from challenging this power – even as it becomes more and more clear that America’s era of world dominance, like Britain’s before it, is drawing to a close.

In addition Obama, without debate or review, has extended the domestic state of emergency proclaimed after 9/11, with its drastic limitations of civil rights (see below). In September 2010 the FBI raided the homes or offices of nonviolent human rights workers in Minneapolis and Chicago, citing a recent Supreme Court ruling that nonviolent first amendment speech and advocacy was a crime if "coordinated with" or "under the direction of" a foreign group designated as "terrorist." It is worth noting that, in nine years, Congress has not once met to discuss the State of Emergency declared by George W. Bush in response to 9/11, a State of Emergency that remains in effect today. Former Congressman Dan Hamburg and I appealed publicly in 2009, both to President Obama to terminate the emergency, and to Congress to hold the hearings required of them by statute. But Obama, without discussion, extended the 9/11 Emergency again on September 2009, and again a year later. Meanwhile Congress has continued to ignore its statutory obligations....continued.

Nine Eleven. 9-11. 9/11. No matter how you type it – those two numbers put together invokes an array of emotions. Terror… fear… anxiety… sadness… vengeance and even evil. But these two numbers also bring with it countless conspiracy theories, coincidences, and unanswered questions that remain even a decade later. And the list is growing larger.

This week, The Black Vault, an online archive with nearly 600,000 pages of declassified government records, obtained a package of documents relating to a seemingly routine emergency preparedness exercise by the National Reconnaissance Office (NRO) – the arm of the military that owns and operates all U.S. spy satellites.

The exercise broke down into multiple phases, which began on September 5, 2001. Each phase was to determine the preparedness of the NRO to various emergencies. The first phase included a NRO employee going into the workplace with a handgun and shooting his supervisor, and another co-worker before dropping the gun and leaving the building.

Simulation personnel along with local police officers overlooked how the NRO structure responded to the scenario. They looked for response times of security officers, how fast a cordoned off area could be established, and they focused on multiple other key details to help the NRO become a more secure workplace.

Each step of the process was carefully timed out… from the time the gunmen shot his supervisor… to the time he exited the building. But the next phase of the exercise, which spanned 9 days total, began on September 11th, 2001, and it was nothing short of eerie.

This phase of the simulation, which began on the morning of September 11, 2001, simulated an aircraft plowing into two of their buildings at NRO headquarters. The simulation had the complete story of the pilots, right down to drinking a “free cup of coffee” before they boarded their flight.

But as this hypothetical tale goes, their flight didn’t end so well. Although it wasn’t a story of terrorism, but rather bad luck, it invokes many questions as to why months earlier – the NRO was beginning to plan a scenario of a plane flying into their buildings to test their response.

Although The Black Vault makes no assertions as to what it really means – it poses some interesting questions that have remained unanswered. Did we really know of a plot similar to this simulation? Did we know when or even how it might be achieved? And maybe the biggest one of all – how did the NRO simulation end up on the very day that 9-11 redefined it’s meaning?

I am writing you now as family.

As you might imagine, I am deeply saddened by this march to war with Iraq. I have worked so hard to secure cooperation with the weapons inspections, precisely so that a confrontation could be avoided. I am deeply proud of the success of my contributions. I have behaved with the utmost respect for the security of the international community and the best interest of disarmament in the Middle East.

Andy, I can still influence this situation.

Therefore, I need to ask you, one last time, what specific actions can be taken by Baghdad, so the President Bush can declare victory without going to War. What do you need? Cooperation on terrorism, including interviewing authority for the FBI? Does the U.S. want the Lukoil Contract? What else? I can get it. Just tell me.

If you call me at 301-891-0954, or send the Secret Service, I will come to you at any hour of the day or night. I will fly to Baghdad with 24 hours notice to deliver any message directly to that leadership, regarding any of the above suggestions or anything else you seek.

Even at this late hour, Andy, I can get the kind of results that will enable President Bush to declare a proud victory without endangering the lives of U.S. soldiers or inciting further terrorist actions against American interest.

I ask you, Andy, what matters more? Trying to depose Saddam Hussein? Or the security of New York City and San Antonia? Which is the priority for America? Because surely you know that the security of New York and Los Angeles and Boston will be forfeited - for years to come - if the U.S. becomes an outright aggressor against Iraq or any other Middle Eastern nation.

My dearest cousin, I want President Bush to succeed. American needs his Presidency to succeed. But this War with Iraq will hurt us, too. In six weeks or six months, it won't matter. Because when it hits, it will hit so hard it will not matter that there was ever a delay - The Iraq people hate Americans, no matter what they think of Saddam. When I was in Baghdad last March, more than one Imam swore to me their people would tear off the arms and the legs of American soldiers, and decapitate them, and drag their bodies through the streets. They swore the women would fight, too.

Once the U.S. bombing starts, the Iraqi exiles will have no credibility as leaders. None whatsoever. They will be hated as pawns of the United States, and my God, let met tell you, Arabs can hate. A U.S. victory will never be sweet for long.

That hatred has kindled deeply because of the sanctions, Andy. Sanctions have killed 1.7 million human beings, including almost one million little children. Stop and think. what would an American father do the the man who killed three of his children, once that father could finally lay hands on his aggressor? Would he throw candy in the streets? No, he'd beat him to death and stab him 100 times until his arms were sore. And then he'd look for the next man, stalking until the right moment. In Baghdad, I met a man who lost 8 members of his immediate family in one year. that's right: Eight dead in ONE year. Multiply that by 20 million.

And so I am coming back to you again. Anytime, day or night, I will meet you anywhere. I will deliver any message. Or I will escort anyone you designate - I will keep our meeting and the substance of our communications strictly confidential. Anything to resolve this crisis. Unlike Ambassador Negroponte, I can do this without drawing media attention.

Above all, you must realize that if you go ahead with this invasion, Osama bin Laden will triumph, rising from his grave of seclusion. His network will be be swollen with fresh recruits, and other charismatic individuals will seek to build on his model, multiplying those networks. And the United States will have delivered the death blow to itself. Using your own act of war, Osama and his cohorts will irrevocably divide the hears and mind of the Arab Street from moderate governments in Islamic countries that have been holding back that tide. Power to the people, what we call "democracy," will secure the rise of the fundamentalists.

And before the next Presidential election, Andy, it will become a disaster.

I confess that since November I’ve been holding my breath, watching the clock for how long Tea Party newcomers could hold out against the entrenched Republican elite on Capitol Hill. Collapse was inevitable, however I admit to feeling bitterly surprised at how rapidly they have thrown in the towel.

For the record, most of the Tea Party quit their principles of liberty on February 14, 2011—20 days into the new Congress—when Tea Party leaders abruptly abandoned their opposition to the Patriot Act and voted to extend intrusive domestic surveillance, wire tapping and warrantless searches of American citizens. In so doing, they exposed the fraud of their soaring campaign promises to defend the liberty of ordinary Americans, and fight government intrusions on freedom. All those wide eyed speeches that flowed with such thrilling devotions, all of it proved to be self-aggrandizing lies.

The Tea Party didn’t even put up a fight. Briefly they rejected a sneak attack to renew three surveillance clauses of the Patriot Act on a suspension vote. That filled my heart with hope. One push from the Republican elite, however and they went down with a loud thud.

My disappointment is particularly acute. Rather notoriously, I am distinguished as the second non-Arab American to face indictment on the Patriot Act, after Jose Padilla.

My status was pretty close to an enemy non-combatant. One would presume that I must have joined some terrorist conspiracy? Or engaged in some brutal act of sedition, such as stock piling weapons and munitions to overthrow those crooks in Congress?

You would be wrong. I got indicted for protesting the War in Iraq. My crime was delivering a warm-hearted letter to my second cousin White House Chief of Staff, Andy Card, which correctly outlined the consequences of War. Suspiciously, I had been one of the very few Assets covering the Iraqi Embassy at the United Nations for seven years. Thus, I was personally acquainted with the truth about Pre-War Intelligence, which differs remarkably from the story invented by GOP leaders on Capitol Hill.

More dangerously still, my team gave advance warnings about the 9/11 attack and solicited Iraq’s cooperation after 9/11.

In August 2001, at the urging of my CIA handler, I phoned Attorney General John Ashcroft’s private staff and the Office of Counter-Terrorism to ask for an “emergency broadcast alert” across all federal agencies, seeking any fragment of intelligence on airplane hijackings. My warning cited the World Trade Center as the identified target. Highly credible independent sources have confirmed that in August, 2001 I described the strike on the World Trade Center as “imminent,” with the potential for “mass casualties, possibly using a miniature thermonuclear device.”

Thanks to the Patriot Act, Americans have zero knowledge of those truths, though the 9/11 Community has zoomed close for years.

Republican leaders invoked the Patriot Act to take me down 30 days after I approached the offices of Senator John McCain and Trent Lott, requesting to testify about Iraq’s cooperation with the 9/11 investigation and a comprehensive peace framework that would have achieved every U.S. and British objective without firing a shot. Ironically, because of the Patriot Act, my conversations with Senator Trent Lott’s staff got captured on wire taps, proving my story.

You see, contrary to rhetoric on Capitol Hill, the Patriot Act is first and foremost a weapon to bludgeon whistleblowers and political dissidents. Indeed, it has been singularly crafted for that purpose.

The American people are not nearly as frightened as they should be. Many Americans expect the Patriot Act to limit its surveillance to overseas communications. Yet while I was under indictment, Maryland State Police invoked the Patriot Act to wire tap activists tied to the Chesapeake Climate Action Network, an environmental group dedicated to wind power, solar energy and recycling. The DC Anti-War Network was targeted as a “white supremacist group.” Amnesty International and anti-death penalty activists got targeted for alleged “civil rights violations.”

All of these are American activists engaged in lawful disputes of government policy. All of them got victimized by the surveillance techniques approved by Tea Party leaders, because they pursued a policy agenda that contradicted current government policies. The Tea Party swore to defend the freedom of independent thinking in Congressional campaigns. One presumes those promises are now forgotten until the next election.

I cannot forget how I was subjected to secret charges, secret evidence and secret grand jury testimony that denied my right to face my accusers or their accusations in open court, throughout five years of indictment. I cannot forget my imprisonment on a Texas military base for a year without a trial or evidentiary hearing.

I cannot forget how the FBI, the US Attorneys Office, the Bureau of Prisons and the main Justice office in Washington — independently and collectively verified my story— then falsified testimony to Chief Justice Michael Mukasey, denying our 9/11 warnings and my long-time status as a U.S. intelligence Asset, though my witnesses had aggressively confronted them. Apparently the Patriot Act allows the Justice Department to withhold corroborating evidence and testimony from the Court, if it is deemed “classified.”

I cannot forget threats of forcible drugging and indefinite detention up to 10 years, until I could be “cured” of believing what everybody wanted to deny— because it was damn inconvenient to politicians in Washington anxious to hold onto power.

Some things are unforgivable in a democracy. The Patriot Act would be right at the top of that list. Nobody who has supported that wretched law should ever be allowed to brag of defending liberty again. That goes for the Tea Party. By voting to extend surveillance of American citizens, they have abandoned the principles of freedom that brought about their rise to power. They have shown their true face.

It is a face that we, the people, will remember. I, for one, have no intention of allowing them to forget.

I just received the following news and I am way too upset to write a coherent piece on this. Ray McGovern is a good friend of mine. We live less than 10 miles apart. Together we have participated in many events and protests. He is one of the most informed, articulate, gentle, peace-loving and peace-seeking human beings I’ve ever known…For me, this hits too close to home: My father was similarly brutalized by dictator regimes, and that was only the beginning, before it escalated to being tortured and having his toenails pulled out by the state police. Why? He was a doctor, a surgeon with an inquiring mind, and he spoke out whenever he could against dictatorships and for liberties. Participating in peaceful demonstrations, encouraging others to rise up for their rights, and reading authors such as Steinbeck (the American author black-listed there as ‘communist and anarchist’) landed him on the list of to-be-punished and pacified…

Right now, at this point, all I have to say to those who second-guess our nation’s police state status is this: “Shame on you!” As for my irate minority friends over here at Boiling Frogs, please help disseminate this news, because the scum bag media won’t;’ thank you.

At Clinton Speech: Veteran Bloodied, Bruised & Arrested for Standing Silently

As Secretary of State Hillary Clinton gave her speech at George Washington University yesterday, condemning governments that arrest protestors and do not allow free expression, 71-year-old Ray McGovern was grabbed from the audience in plain view of her by police and an unidentified official in plain clothes, brutalized and left bleeding in jail. She never paused speaking. When Secretary Clinton began her speech, Mr. McGovern remained standing silently in the audience and turned his back. Mr. McGovern, a veteran Army officer who also worked as a C.I.A. analyst for 27 years, was wearing a Veterans for Peace t-shirt.

Blind-sided by security officers who pounced upon him, Mr. McGovern remarked, as he was hauled out the door, “So this is America?” As you see, Mr. McGovern is covered with bruises, lacerations and contusions inflicted in the assault.

Mr. McGovern is being represented by the Partnership for Civil Justice Fund (PCJF). “It is the ultimate definition of lip service that Secretary of State Clinton would be trumpeting the U.S. government’s supposed concerns for free speech rights and this man would be simultaneously brutalized and arrested for engaging in a peaceful act of dissent at her speech,” stated attorney Mara Verheyden-Hilliard of the PCJF.

The subsequent release regarding occupied Iraq was an even more ridiculous document dump; even more detrimental to the movement for justice. All of Iraq’s chaos was blamed on Iran and Iraq itself. No mention of imported Israeli torture tactics, Mossad wreaking havoc with car bombs and IEDs from Mosul to Baghdad to Najaf, Karbala and Basra, Israeli intelligence stealing Iraq’s history and training Kurdish collaborationist militias in the north or more than 70 Zionist-owned companies annexing land across the occupied nation. And obviously, no mention of Israeli-trained PKK killing American occupying forces on the ground, creating the illusion of war. Nearly 400,000 documents and the name of Zion was nowhere to be found.

An Israeli MK even cited Wikileaks as a means to try the United States of America, the Zionist entity’s patron in the amount of at least $3 billion a year, for war crimes before the UN. The brazen MK went as far as filing a complaint with the UN Security Council. The same UN, that did Israel’s bidding 20 years ago and implemented genocidal sanctions against Iraq that murdered 1.7 million Iraqis including 600,000 children.

The Seletun Scientific Panel recommends significant reduction of EMF exposure limits because of current scientific uncertainty and to protect the health of the vulnerable in society.

In November 2009, a number of prominent scientists met at Seletun, in Norway, to discuss their concerns about the proliferation of radiation-emitting technology and the effects on health that this was believed to be having.

They concluded that public exposure levels are too high, and that this leads to significant bio-effects, such as cancer, infertility, DNA damage, mood changes, concentration and learning problems, Alzheimer's disease, ALS, sleep disruption and many other measures of health, disrupting the lives of millions of people. No account is taken of the synergistic effects of combinations of frequencies which could make these risks far worse.

The Seletun Scientific Panel, composed of scientific experts present at the conference, are calling for a new approach to the protection of public health, with governments taking decisive action now to protect the lives of people, especially those who are vulnerable - predicted to be between 40-50% of the population (the elderly, the ill, those who are genetically and/or immunologically challenged) - and, of course, our growing and developing children, our future. We also need to protect our economic life, which could be devastated by the ill-health of so many people of working age.

The Seletun Scientific Panel agreed on 10 proposals,including government action.

* The global population is at risk.

* Sensitive populations are currently vulnerable.

* Government actions are warranted NOW based on evidence of serious disruption to biological systems.

* The burden of proof for the safety of radiation-emitting technologies should fall on producers and providers; NOT CONSUMERS.

* EMF exposures should be reduced in advance of complete understanding of mechanisms of action.

* The current accepted measure of radiation risk - the Specific Absorption Rate (SAR) - is inadequate and misguides on safety and risk.

* An international disease registry is needed to track time trends of illnesses to correlate illnesses with exposures.

* Pre-market health testing and safety demonstration of all radiation-emitting technologies.

* Parity needed for occupational exposure standards. Though workers may overall be healthier than the public in general, it also includes women of child-bearing age whose foetuses could be damaged and men whose fertility could be compromised.

* Functional impairment designation for persons with electrohypersensitivity.
